Terms and Conditions 

Effective Date: April 15, 2024

1. Scope of Work and Deliverables:

  • All services provided by Neo-scenic Designs will be clearly outlined in the initial quotation, including a detailed description of the project scope, deliverables, and excluded services.
  • Unless explicitly stated, Neo-scenic Designs does not include structural engineering, HVAC, plumbing, electrical, or other design/engineering services. These can be quoted separately upon request.

2. Payment Terms:

  • A 50% deposit is required to begin any project.
  • The remaining 50% balance is due before the release of unwatermarked final drawings.
  • Full payment is required upon delivery of the agreed deliverables, regardless of pending approvals or feedback from third parties (such as truss manufacturers or municipal reviewers). We will continue to work on necessary revisions based on municipal feedback and, third-party reviews after payment is received.
  • Any additional work outside the original scope will be billed separately.

3. Site Visits:

  • Site visits are an essential part of many projects, allowing us to evaluate site conditions and provide tailored design solutions. Site visit fees apply whether or not the client decides to move forward with the project.

4. Project Timeline:

  • Project timelines will be discussed at the start of each project, and they depend on client responsiveness and the involvement of third parties. Delays in client approvals or third-party services may result in extensions to the timeline.

5. Revisions and Feedback:

  • Neo-scenic Designs includes revisions based on feedback from the municipality as part of the original contract. However, any revisions required by third parties or additional changes requested by the client will be billed separately.
  • All revisions requested after the final delivery of the project are billed at our hourly rate.

6. Additional Costs:

  • The client is responsible for securing third-party services such as engineering or truss design unless specifically included in the agreement.
  • Any third-party costs required for the completion of the project will be billed separately and quoted in advance.

7. Ownership, Marketing, and Reuse of Designs:

  • Neo-scenic Designs retains the right to reuse any design elements created during the course of the project in future projects, provided those design elements are not proprietary to the client.
  • Neo-scenic Designs reserves the right to use completed projects in its portfolio and marketing materials, including images, descriptions, and other promotional content, unless the client requests otherwise in writing.

8. Client Responsibilities:

  • Clients are responsible for providing accurate and timely information, approvals, and decisions to avoid project delays. Neo-scenic Designs is not responsible for delays caused by the client's failure to provide necessary information or approvals.

9. Dispute Resolution:

  • In the event of a dispute, Neo-scenic Designs and the client will attempt to resolve the issue through good-faith negotiation. If an agreement cannot be reached, both parties may proceed to mediation or arbitration before taking legal action.

10. Cancellation Policy:

In the event that the client decides to cancel the project after work has commenced, Neo-scenic Designs will bill the client at the agreed-upon hourly rate for the time spent on the project up until the point of cancellation, along with any expenses that may have been incurred. These expenses may include, but are not limited to, third-party fees, materials, and travel costs related to site visits. A final invoice will be issued for the total time and expenses incurred, and any unused portion of the deposit will be refunded to the client.

11. Governing Law:

  • All contracts and agreements entered into with Neo-scenic Designs are governed by the laws of Ontario, Canada.
